negligentactsand/oromissionsof its suppliersof serviceswhich formpartof theCruisePackage,

limits its liability,whereapplicable,by the InternationalAirConventions,

including theWarsawConvention1929 (asamendedbyTheHagueProtocol1955or the

MontrealProtocol1999orotherwise).Flightsbetween theUKandanymember stateof the

EuropeanUnionarecurrentlygovernedbyECRegulations889/2002whichgives legaleffect

to theMontrealConvention1999.To theextent that

maybe liableasa

non-performingaircarrier toGuests in respectofcarriagebyair, the termsof the International

AirConvention (includingany subsequentamendmentsandanynewconventionwhichmaybe

applicable toaContract foraCruiseorCruisePackagebetween the

anda

Guest)areexpressly incorporated into theseBookingConditions.The internationalAirConvention

maypermit thecarrier to limit its liability fordeathandpersonal injury, lossofanydamage to

luggageanddelay; in so faras

mayhaveany liability to theGuest in respectof

Carriageof you,yourBookingPartyand your luggageby sea isgovernedbyEURegulation

392/2009on theLiabilityofPassengersbySea in theEventofAccidents (‘RegulationEC

number392/2009’)orwhereapplicable theConvention relating to theCarriageofPassengers

and theirLuggagebySea1974asamendedby the1976Protocol (‘AthensConvention’),which

areexpressly incorporated into theseBookingConditions,andany liabilityof

DisneyCruiseLine

fordeathorpersonal injuryor for lossordamage to luggagearisingoutofcarriageby sea shall

bedetermined solely inaccordancewith theseprovisions.EURegulation392/2009andThe

AthensConvention limit theCarrier’s liability fordeathorpersonal injuryor lossordamage to

luggageandmakes specialprovision for valuables.Luggage ispresumed tohavebeendelivered

undamaged to youunlesswrittennotice isgiven to

and/or theCarrier: (i) in the

caseofapparentdamage,beforeorat the timeofdisembarkationor redelivery;or (ii) in thecase

ofdamagewhich isnotapparentorof loss,within15days from thedateofdisembarkationor

Anydamagespayableby

defences, immunitiesand limitationsavailable, respectively, to theactualcarrierandunder the

relevantConventions,andnothing in theseBookingConditions shallbedeemedasa surrender

thereof.To theextent thatanyprovision in theseBookingConditions ismadenulland voidby

theWarsawConvention, theMontrealConventionorEURegulation392/2009orTheAthens

Conventionorany legislationcompulsorilyapplicableor isotherwiseunenforceable, it shallbe

void to thatextentbutnot further.

’s liabilitywillnotatany timeexceed that

ofanycarrierunder itsConditionsofCarriageand/orapplicableor incorporatedconventionsor

other legislation.

Except forclaimsarisingoutofcarriagebyair,any liability in respectofdeathandpersonal injury

may incur to youor yourBooking

Party,whetherunder theContractwith you inaccordancewith theseBookingConditionsor

otherwise,shallalwaysbe subject to the limitsof liabilitycontained inRegulationECnumber

Notwithstandinganything to thecontraryelsewhere in theseBookingConditions,

shallnot inanycircumstancesbe liable to youor yourBookingParty forany lossor

anticipated lossofprofit, lossof revenue, lossofuse, lossofcontractorotheropportunitynor for

anyotherconsequentialor indirect lossordamageofa similarnature.Forclaimsnot involving

personal injury,deathor illnessorwhicharenot subject to theConventions referred toabove,any

liability

may incur for thenegligentactsand/oromissionsof its suppliers shall

be limited toamaximumof thepricewhich youpaid for theContractnot including insurance

’s liabilitywillnotexceed£500.

willnotatany timebe liable forany lossofordamage to valuablesofanynature.

Hotels,shuttle servicesorotherelementsofaCruisePackageorCruisewillbearrangedby

Disney

CruiseLine

with local suppliers,whomay themselvesengage the servicesof localoperatorsand/

or sub-contractors.Standardsofhygiene,accommodationand transport in somecountrieswhere

excursions takeplaceareoften lower thancomparable standards in theUK.

DisneyCruiseLine

willendeavour toappoint reputableandcompetent local suppliers.The termsandconditionsof

the supplierswillbeapplicableandareexpressly incorporated into theContract.Thesemay limitor

exclude liabilityof the supplier.The liabilityof

DisneyCruiseLine

willnotexceed thatofany supplier.

Local lawsand regulationsof the relevantcountrywillbe relevant inassessingperformanceof the

servicesofany supplier. In theeventofacomplaintby youor yourBookingParty, thisContractwill

be regardedashavingbeenperformed if local lawsand regulations relating to those serviceshave

been satisfied,even if the lawsofEnglandandWaleshavenotbeenmet.

TheVesselcarriesonboard serviceproviderswhooperateas independentcontractors.Neither

DisneyCruiseLine

nor theCarrier is liable for theactsofomissionsof independentcontractors.

Their servicesandproductsarechargedasextras.Neither

DisneyCruiseLine

nor theCarrier is

responsible for theirperformanceorproducts.Thesecontractorsmay includeadoctor,medical

personnel,hairdresser,manicurist,masseuse,photographer,entertainer,fitness instructors,spa

personnel,beauticians, internet/I.T.personnelorother instructionalconcessionaires,artorother

auctioneers,shopkeepersandothersproviding services.The limitations referred toherein shall

apply toall independentcontractors.Thesecontractorsworkdirectly for youor yourBookingParty

whenperforming their services.Neither

DisneyCruiseLine

nor theCarrier is responsible forany

suchcontractor’sactsoromissions inprovidinggoodsor services to youor yourBookingParty.

Such independentcontractors, includingShoreExcursionproviders,donotatany timeactas

agentsor representativesof

DisneyCruiseLine

or theCarrier.Neither

DisneyCruiseLine

nor

theCarrierownsorcontrolsany such independentcontractors,makesno representationofany

kindas to theirperformanceanddoesnotundertake to superviseorcontrol theiractivities.Any

Guestusing the servicesoractivitiesof such independentcontractors shallbedeemed toagree

andconsent thatany liability foranydeath,personal injury, illness,emotionaldistress,mental

sufferingorpsychological injury to suchGuestor lossofordamage toproperty shallbe the sole

responsibilityof the independentcontractorproviding such serviceoractivity.Neither

nor theCarrier shallbeorbecome liableor responsible inanyway foranyactoromission

ShoreExcursionsdonot formanypartof theContract.ShoreExcursionsmaybe reservedafter

aCruisehasbeenbooked.ShoreExcursionsbookedwillbe suppliedby localoperators.

local lawsand regulationsof the relevantcountry.ShoreExcursionoperatorsarenot

liabilitywhatsoever foranyactsoromissionsof theShoreExcursionoperators.

BookingPartymustensure that youarefitandhealthy toundertakeShoreExcursions.AllShore

damagedirectlyor indirectlyoccasionedbycircumstanceswhereperformanceand/orprompt

’semployeesorother, terroristactivityor the threat

of terroristactivity, failureof suppliersofpower,health risksorepidemics,naturalornucleardisaster,

fireoradverseweatherconditionsoradverse sea states.AnyGuest’s suicideorattempted suicide

oraGuest’sdeliberateexposure tounnecessarydanger (except inanattempt to savehuman

life)or theconsequencesofparticipating inanunusualanddangerousactivityandall similar

circumstancesareout thecontrolof

shall innoeventbe liable for the lossofordamage tocash,negotiable

securities,gold,silverware, jewellery,ornaments,worksofart,photographic/video/audioequipment

Byboarding theVessels,youand yourBookingParty represent yourselvesasphysicallyand

otherwisefit to traveland that yourconductorconditionwillnot impair the safetyorconvenience

of theVessels,aircraftand/or theotherGuests.

reserves the right to require

youor yourBookingParty toproducemedicalevidenceoffitness to travelon theCruiseor

CruisePackage. If youor yourBookingPartyhaveamedicalconditionwhich requires youor

them to takeprescriptionmedicationormay require youor them toobtainmedicalcareduring

thecourseof yourCruiseorCruisePackage,pleaseconsultwith yourpersonaldoctorprior to

travelling.Youneed tomake yourdoctor fullyawareof theVessel’s itineraryas thismayaffect your

doctor’sdecisionwith regard tofitness to travel,whichmaybedependentupon theavailabilityof

anyemergencymedical treatment. If youor yourBookingPartyhasacondition thatmayaffect

shallbeentitled toadministerapublichealthquestionnaire.Youand your

BookingParty shall supplyaccurate information regarding symptomsofany illness includingbut

not limited togastro-intestinal illnessand/orH1N1 virus.

and/or theCarrier

maydenyboarding to you,oramemberof yourBookingParty, if

DisneyCruiseLine

and/or the

Carrier, in its solediscretion,considers youoramemberof yourBookingParty tohave symptoms

ofany illness, includingbutnot limited togastro-intestinal illnessand/orH1N1 virus.Refusalby you

or yourBookingParty tocomplete thequestionnairesmay result indeniedboarding. If youora

memberof yourBookingParty isdeniedboarding youwill incur100%cancellation feesandwill

have tomakeaclaimunder your travel insurance.

If youoramemberof yourBookingPartybecomes illonboard theVesselwith viral,bacterialor

other illness, theonboarddoctorand/or theCarriermay request them to remain in their stateroom

for reasonsofhealthand safety.A refusalby youor yourBookingParty to remain in your

stateroommay result in theCarrierdebarking youor yourBookingParty for reasonsofhealthand

safetyand/orpursuant to thepowersof theMaster.

You recogniseandaccept that theCarrier isnot in thebusinessofprovidingmedical services

and/oroperatingmedical facilities.Anymedicalpersonnelonboard theVesselareprovidedas

independentcontractors solely for theconvenienceof youor yourBookingPartyand theyarenot

employees,agents,or representativesofCarrier.TheCarrierdoesnotcontrol themedical services

anddoesnotundertake to superviseanycareor treatmentprovidedbymedicalprofessionals

aboard theVessel.AlthoughCarrier shallbeentitled tochargea fee forarranging such services,

all suchpersonsorentitiesprovidingmedical services shallbedeemed independentcontractors

andnotactingasagentsor representativesofCarrier.Neither

norCarrier shall

be liable foranydeath,personal injury, illness,emotionaldistress,mental sufferingorpsychological

injurycausedby reasonofany treatment,diagnosis,advice,examination,prescriptionorother

serviceprovidedby suchmedicalpersonnel,or,by the failureof suchmedicalpersonnel to

provideany treatment,diagnosis,advice,examination,prescriptionorother service.

It is yourobligationand responsibility to seekmedicalassistance from thedoctoronboard the

Vesselasandwhennecessaryduring theCruise.

Thedoctorandmedicalpersonnelonboardarenot specialistsand theVessel’smedicalcentre

isnot required tobeand isnotequipped to the same standardsasa land-basedhospital.The

Vesselcarriesmedical suppliesandequipment incompliancewithflag state requirements.Neither

DisneyCruiseLine

, theCarriernor thedoctor shallbe liable to youor yourBookingPartyasa

resultofany inability to treatanymedicalconditionasa result.

Medical facilitiesand standards in the variousportsofcallmay varyandmaybe limited.Neither

DisneyCruiseLine

nor theCarriermakesany representationsorwarranties regarding thequality

or standardsofmedical treatmentatanyportofcallorotherplacesatwhich youor yourBooking

Party is landed.Neither

DisneyCruiseLine

nor theCarrier shallbe liable inanyway for referring

youor yourBookingPartyashore formedical servicesor for theactualmedical services rendered

ashore. In theevent thatmedicalattendanceofanykindorambulanceassistance,whetheron

shore,at seaorbyair is requiredand isprovidedororderedby

DisneyCruiseLine

, theCarrier,

theMasteror theonboarddoctor,youoramemberof yourBookingParty ifconcerned,shall

be liable for the fullchargeorcost thereofand shall indemnify

and theonboarddoctor/medicalprovideruponfirstdemandofanycosts incurredby

, theCarrier,or theonboarddoctor/medicalprovider,or theiremployeesoragents. If

youoramemberof yourBookingPartyby reasonof illnessor throughanyothercause requires

specialorextraaccommodationor specialorextraattentionduring thecourseof theCruiseor

CruisePackage,youwillbechargedaccordingly.Youareadvised toensure that your insurance

coversmedical treatment,evacuationand repatriationduringallaspectsof theCruise forall your

BookingParty.

GUEST RESPONSIBILITY

Youhaveaduty toobey the lawful requestsof theVessel’sMasterordelegatedOfficerswhilston

boardand securityorother lawful reasons toallow them to search youor yourBookingParty,your

stateroom(s), luggageand/orbelongings.Youand yourBookingPartyherebyexpresslyagree to

allowany such search.

Youand yourBookingPartymusthave receivedallnecessarymedical inoculationsprior to the

Cruiseandhave in yourpossessionall tickets,validpassport,visas,medicalcards,andanyother

documentsnecessary for the scheduledportsofcallanddebarkation.

DisneyCruiseLine

and/or theCarrierofanyVesseloraircraft reserves the right in theirabsolute

discretion to refuseboardingordebarkatanyport youor yourBookingParty if youror their

conduct is,or in itsor their reasonableopinion is, likely toendangeror impair thecomfortand

enjoymentofotherGuestsonboard.

noranyCarrierwillbeunderany liabilitywhatsoever to youor your

BookingParty in respectofanybreachornon-observanceby youor yourBookingPartyof

theprovisionsof theseclauses.Youand yourBookingPartymust indemnify

Yourbehaviourand thatof yourBookingPartymustnotcompromise the safety,peaceand

ofanykind isallowedonanyVessel.

HOLIDAY SHOPPING

Retailestablishments indestinationportsmaybeclosed forcertainholidays.

RIGHT TO CHANGE ITINERARY/DETENTION

DisneyCruiseLine

may in its solediscretionandwithoutpriornoticechange,substitute,postpone,

cancelordeviate fromany scheduled sailing, itineraryorcallatanyport,andmay substitute

another vessel for theVessel,and shallnotbe liable forany lossordamage incurredby youor

yourBookingPartyasa resultofany suchchange,substitution,postponement,cancellationor

deviation.Youand yourBookingParty shallpayanyandallexpenses incurred if youoramember

of yourBookingParty isdetainedonboard theVesselorelsewhereatany stageofa voyage

becauseofquarantine,port regulations,prevailingapplicable law, illnessorothercause.

TRANSFER OF A CRUISE OR CRUISE PACKAGE

Abookingmaybe transferred toanotherGuestprovided that

DisneyCruiseLine

receives the

transfer requestmore than56daysbefore the scheduleddeparturedate.Between56and14

days inclusivebefore the scheduleddeparturedate,

DisneyCruiseLine

willnormallyagree to
